Your Movida terms & conditions are outlined below. Please read through thoroughly your terms and conditions.

  1. In these Terms and Conditions, unless the context requires otherwise:
    1. A reference to the singular includes a reference to the plural, and vice versa;
    2. Headings are for convenience and do not form part of these Terms and Conditions or otherwise affect the interpretation of these Terms and Conditions; and
    3. Any words following the terms "including", "include", "for example" or any similar expression shall be construed as illustrative and shall not limit the sense of the words, description, definition, phrase or term preceding those terms.

  1. The Movida Loyalty Scheme is managed and operated by MCAM.
  2. Movida is open to individuals aged 18 or above.
  3. Creation of a Movida account is at the sole discretion of MCAM and MCAM may refuse to create a Movida Account for any person.
  4. Participation in the Movida must be activated online at www.mcamaviation.com or in the app.
  5. Movida members will be issued with a unique Movida Account number.
  6. Movida rights and benefits (including Movida Points) are not transferable and may only be used by the Movida Account Holder.
  7. Movida Account Holders are permitted to hold more than one Movida account but they must be operated separately and under no circumstances can they be merged or Movida Points transferred between the Movida accounts.
  8. MCAM reserves the right to modify Movida structure, benefits and other features (including these Terms and Conditions) and to terminate Movida at any time upon reasonable notice, where possible, and MCAM will not be liable for any loss or damage resulting therefrom.

  1. Movida Account Holders may nominate another individual (Nominee) (who must be at least 18 years of age) to have access to their Movida Account to:
    1. Obtain information in respect of that Movida Account;
    2. Redeem Movida Points on behalf of that Movida Account Holder; and
    3. Amend any information held by MCAM concerning that Movida Account on behalf of that Movida Account Holder.
  2. All Movida Account activity conducted by the Nominee will be viewed as being conducted on behalf of the Movida Account Holder and the Movida Account Holder will be responsible for any breach of these Terms and Conditions by the Nominee.
  3. Prior to appointment, the Nominee will be required to provide MCAM with proof of identity and contact details. The Nominee and the Movida Account Holder confirm that all information provided relating to the identity and contact details of the Nominee are true and accurate and that the provision of any false information will result in the Nominee's appointment being terminated. MCAM reserves the right in such circumstances to also terminate the Movida Account of the Movida Account holder in accordance with paragraph 7.
  4. A Nominee is not entitled to any Movida Scheme benefits in respect of the Movida Account to which it is granted access.

  1. Movida Points are, subject to the following provisions, earned as follows:
    For each sale, 1% of the sale value will be earned in points. 1 point will be equivalent to 1 GBP. For example, if the sales price of a jet charter with MCAM is GBP 10,000 then 1% of this will equate to 100 points. This will earn GBP 100. If the sale is made in another currency, then the sale value will be converted into GBP using the daily exchange rate from the website www.xe.com
  2. Movida Points are earned from the first booking with MCAM
  3. Movida Points cannot be earned on points being redeemed
  4. Eligibility for Earned Movida Points will automatically expire if a person fails to activate their Movida Account within 30 days following completion of their first aircraft charter booking with MCAM.
  5. Except in circumstances where the cancellation fee paid is equal to the full amount of the fee for the Booking, if a Booking or a flight is cancelled for any reason, no Movida Points will be earned in respect of that Booking.
  6. Movida Points may not be gifted or otherwise transferred to non-Movida Account Holders or between Movida Accounts.
  7. MCAM reserves the right of final decision in case of any disputes regarding Movida Points and may require the submission of documentation by Movida Account Holders in order to resolve disputes.

  1. Movida Points, and all rights of title to and property in Movida Points issued at any time, remain with MCAM at all times and never pass to Movida Account Holders.
  2. Risk (for example, theft or unauthorised or fraudulent redemption) associated with Movida Points pass to Movida Account Holders as soon as the Movida Points are credited to their Movida Accounts. MCAM is not liable for unauthorised or fraudulent redemptions arising due to the actions of Movida Account Holders, Nominees or other persons or the failure by Movida Account Holders or Nominees to adhere to these Terms and Conditions.

  1. Movida points can be redeemed once the minimum threshold of 100 points has been reached. If the redemption of points takes the remaining balance of points below the minimum threshold, the threshold will have to be met before points can be redeemed each time.
  2. Movida points can be redeemed after the first flight booking is completed and flown.
  3. Points can be redeemed on flights and services booked with either MCAM Aviation and/or MCAM Lifestyle.
  4. Movida Points can only be redeemed for the benefit of the Movida Account Holder who holds the Movida Account by accessing their Movida account online / on the app or by calling your MCAM representative.
  5. All taxes, duties and carrier-imposed charges (including airport and/or government taxes) are the responsibility of Movida Account Holders and must be paid prior to the redemption of Movida Points. Movida Points cannot be redeemed against such charges in any circumstances.
  6. Unredeemed Movida Points will automatically expire 24 months following the date of the relevant completed Booking.

  1. Movida Account Holders may terminate their participation in Movida at any time by giving written notice to MCAM, at which time any unredeemed Movida Points in the Movida Account of that Movida Account Holder will automatically expire.
  2. MCAM may immediately and without notice terminate a Movida Account Holder's right to participate in Movida and to earn and redeem Movida Points:
    1. If the Movida Account Holder is the subject of a bankruptcy petition or order;
    2. In the event of insolvency of MCAM;
    3. If MCAM has reasonable grounds to suspect any misconduct, fraud or other illegal act, improper or dishonest activity, misuse of Movida Points, misuse of MCAM facilities and services or breach of these Terms and Conditions; or if the Movida Account Holder is the subject of a bankruptcy petition or order;
    4. If MCAM in its absolute discretion considers the acts or omissions of the Movida Account Holder to be damaging to the reputation or goodwill of MCAM.
      In all such circumstances, any unredeemed Movida Points in the Movida Account of that Movida Account Holder will automatically expire.
  3. Termination of rights to participate in Movida for whatever reason will, subject to the foregoing provisions, be without prejudice to the accrued rights and remedies of MCAM and the Movida Account Holder
  4. If a Movida Account Holder passes away, their Movida Account will be closed and any unredeemed Movida Points in that Movida Account will automatically expire.

  1. All personal data supplied by Movida Account Holders is managed in accordance with MCAM's privacy policy. Such Privacy Policy is deemed to be incorporated into these Terms and Conditions.
  2. Movida Account Holders are responsible for keeping MCAM up to date as to their correct personal details. Failure by Movida Account Holders to provide or keep required data up to date may result in MCAM being unable to provide a Movida Account. In such cases, the right of the Movida Account Holder to participate in the Movida Scheme may be terminated.
  3. MCAM is not responsible for any loss as a result of a Movida Account Holder's failure to notify MCAM of a change of personal details.

  1. MCAM shall not be liable to any Movida Account Holder for any special, indirect or consequential loss, damage or expense of any kind whatsoever arising out of or in connection with Movida and/or the allocation or the refusal to allocate any Movida Points and/or the redemption or the refusal to permit the redemption of any Movida Points, whether such loss, damage or expense is caused by negligence or otherwise, and whether MCAM has any control over the circumstances giving rise to the claim or not.
  2. Nothing in these Terms and Conditions will limit or exclude MCAM's liability for:
    1. Death or personal injury caused by its negligence, or the negligence of its employees, agents or subcontractors;
    2. Its fraud or fraudulent misrepresentation; or
    3. Any other liability which cannot be limited or excluded by applicable law.
  3. Subject to paragraphs 9.1and 9.2, the liability of MCAM in contract, tort (including negligence) or otherwise with respect to any claim arising in respect of its acts or omissions in operating the Movida Scheme (Claim) will be limited to the value of the unredeemed Movida Points in the Movida Account of the Movida Account Holder bringing the Claim.
  4. MCAM confirms that it will operate the Movida Scheme with reasonable care and skill, but all terms expressed or implied by statute or otherwise on the part of MCAM are hereby excluded to the fullest extent permitted by applicable law.

  1. These Terms and Conditions (together with any other terms and conditions incorporated into these Terms and Conditions) constitute the entire agreement between MCAM and Movida Account Holders and supersede and extinguish all previous agreements, promises, assurances, warranties, representations and understandings between them, whether written or oral, relating to its subject matter.
  2. Movida Account Holders will not have any remedies in respect of any statement, representation, assurance or warranty (whether made innocently or negligently) that is not set out in these Terms and Conditions. Movida Account Holders agree that they will have no claim for innocent or negligent misrepresentation based on any statement in these Terms and Conditions.
  3. A failure or delay by MCAM to exercise any right or remedy provided under these Terms and Conditions or by law will not constitute a waiver of that or any other right or remedy, nor will it prevent or restrict any further exercise of that or any other right or remedy. No single or partial exercise by MCAM of any right or remedy provided under these Terms and Conditions or by law will prevent or restrict the further exercise of that or any other right or remedy.
  4. If any provision or part-provision of these Terms and Conditions is or becomes invalid, illegal or unenforceable, it will be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification is not possible, the relevant provision or part-provision will be deemed deleted. Any modification to or deletion of a provision or part-provision under this paragraph 10.4 will not affect the validity and enforceability of the rest of these Terms and Conditions.
  5. Movida Account Holders may not assign, mortgage, charge, declare a trust over or deal in any other manner with any or all of their rights and obligations under these Terms and Conditions without the prior written consent of MCAM.
  6. A person who is not a party to these Terms and Conditions shall not have any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of these Terms and Conditions.

  1. These Terms and Conditions and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) will be governed by and construed in accordance with the law of England and Wales.
  2. The courts of England and Wales will have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter or formation (including non-contractual disputes or claims).
